These Terms & Conditions ("Terms") govern your use of the Milan & Co. website and the SMS/MMS messaging program operated by Milan Skokic, a licensed Arizona real estate agent (License SA693972000, MLS ID MS1179) with Orchard Brokerage (LC699746000), based in Tempe, Arizona ("Milan & Co.," "we," "us," or "our"). By submitting our contact form, opting in to text messages, or otherwise using this website, you agree to these Terms.
1. Real estate services
Milan & Co. provides real estate brokerage services in Arizona through Orchard Brokerage. Information on this website is for general informational purposes only, is not a solicitation to buy or sell property where prohibited, and does not create an agency or fiduciary relationship until a written representation agreement is signed. All real estate services are provided in compliance with Arizona Department of Real Estate rules and applicable fair housing laws.
2. SMS/MMS messaging program terms
The following disclosures apply to our SMS/MMS messaging program and are required by mobile carriers and our messaging platform (Follow Up Boss).
Program name & purpose
Milan & Co. Real Estate operates an SMS/MMS program to respond to real estate inquiries and to send appointment confirmations, listing information, market updates, and follow-up messages to individuals who have opted in.
How to opt in
You may opt in to text messages by checking the SMS consent box on our contact form at milanandco.com. By opting in, you provide your prior express written consent under the Telephone Consumer Protection Act (TCPA) to receive SMS/MMS messages from Milan & Co. at the mobile number you provided, including messages sent using an automatic telephone dialing system.
Consent is not a condition of purchase of any goods or services and is not required to work with Milan & Co.
Message frequency & cost
Message frequency varies based on your inquiry and activity. Message and data rates may apply according to your mobile carrier plan. Milan & Co. does not charge a fee to receive messages.
Help & opt-out
Text HELP to any message you receive from us for assistance, or contact us at (480) 978-6974 or mike.skokic@orchard.com.
You may opt out of text messages at any time by replying STOP, END, CANCEL, UNSUBSCRIBE, or QUIT to any text message from us. You will receive a single confirmation message and will not receive further SMS/MMS messages from the program. You may also opt out of all channels (SMS, calls, email) using the form on our Privacy & Communications page.
Supported carriers
Our SMS program is compatible with all major U.S. mobile carriers, including AT&T, Verizon Wireless, T-Mobile, Sprint, U.S. Cellular, Boost, MetroPCS, Google Voice, and others. Carriers are not liable for delayed or undelivered messages.
No sharing of consent or mobile information
Mobile information and SMS opt-in consent will not be shared with third parties or affiliates for marketing or promotional purposes. Information you provide is shared only with (a) our brokerage and licensed team members involved in serving you, and (b) service providers that help us operate our messaging and CRM systems (such as Follow Up Boss and its SMS provider), subject to their own confidentiality obligations. 3. Acceptable use of the website
You agree not to (a) submit false or misleading information, (b) impersonate another person, (c) use the site to send unsolicited communications, or (d) attempt to disrupt, reverse-engineer, or gain unauthorized access to the site or its infrastructure.
4. Intellectual property
All content on this website — including text, graphics, logos, and photography — is the property of Milan & Co. or its licensors and is protected by applicable copyright and trademark laws. You may not reproduce, distribute, or create derivative works without our prior written consent.
5. Disclaimers
The website and any information provided are offered on an "as is" and "as available" basis without warranties of any kind, express or implied. Property information, market statistics, and third-party listings are believed to be reliable but are not guaranteed to be accurate, current, or complete. Nothing on this site constitutes legal, tax, or financial advice.
6. Limitation of liability
To the fullest extent permitted by law, Milan & Co., Orchard Brokerage, and their respective agents will not be liable for any indirect, incidental, special, or consequential damages arising out of your use of the website or the SMS/MMS program, even if advised of the possibility of such damages.
7. Governing law
These Terms are governed by the laws of the State of Arizona, without regard to conflict-of-law principles. Any dispute arising out of or relating to these Terms or your use of the website will be resolved in the state or federal courts located in Maricopa County, Arizona.
8. Changes to these Terms
We may update these Terms from time to time. Updates take effect when posted on this page, and the "Last updated" date above will reflect the most recent revision. Continued use of the website or the SMS/MMS program after an update constitutes your acceptance of the revised Terms.
